Era figlio di Patrick Hepburn, 3º conte di Bothwell, e di Agnes Sinclair (morta nel 1572), figlia di Henry Sinclair, 3º Lord Sinclair, e fu chiamato The Master of Bothwell dalla nascita. Successe a suo padre come conte di Bothwell e Lord Hailes nel 1556.
